The dispute arose over advances recorded in a seized red diary, reflecting an excess of debit over credit balances treated by the Assessing Officer as unexplained investments. The assessee maintained these were commercial advances to farmers, fully returned within the year and covered by his own capital of Rs.91.73 lacs, but lacked external confirmations. The AO also applied notional interest on the impugned advances.
The Commissioner (Appeals) limited the addition to Rs.53,21,510/-, rejecting the broader unexplained investment claim, and declined to apply notional interest. The Income Tax Appellate Tribunal agreed, finding no fault in considering diary entries as a whole and placing no additional onus on the assessee. The Tribunal’s decision to confine the addition to Rs.53.21 lakh stands affirmed.
